1. Definitions
1.1 ‘Buyer’ means the person who buys or agrees to buy the Products from the Seller.
1.2 ‘Seller’ means Silcox & Wicks Ltd, registered in England & Wales at Companies House no 04140346 , VAT registration number 763 1273 38. Online we trade as nowforbed.co.uk, and in our shop we trade as Silcox & Wicks. We can be located at 103 Cricklade Street, Cirencester, Gloucestershire GL7 1JF. Our registered address is Prospect House 5 May Lane, Dursely, Gloucestershire GL11 4JH and this address is suitable for the serving of documents.
1.3 ‘Conditions’ means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.
1.4 ‘Delivery Date’ means the date specified by the Seller when the Products are to be delivered.
1.5 ‘Price’ means the price for the Products including packing and VAT.
1.6 ‘Products’ means those goods specified.
2. Conditions Applicable
2.1 Nothing in these conditions shall affect the Buyer’s statutory rights as a consumer.
2.2 The Seller shall sell and the Buyer shall purchase the Products in accordance with a written quotation off the Seller which is accepted by the Buyer, or any written or verbal order of the Buyer which is accepted by the Seller including but not limited to orders placed via the Seller’s Web site, subject in any case to these conditions, which shall govern the contract to the exclusion of any other terms and conditions subject to which any such quotation is accepted or purported to be accepted, or any such order is made purported to be made, by the Buyer.
2.3 Any typographical or clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the Seller shall be subject to correction without any liability on the part of the Seller.
2.4 If any provision of these conditions is adjudged invalid or unenforceable in whole or part the validity of the other provisions of these conditions and the remainder of those provisions in question shall not be affected.
3. Availability
3.1 Included with our confirmation of your order will be details of our stock availability and anticipated delivery timescales. These are estimated delivery time given to us by our manufacturers.
3.2 If we need to order direct from the manufacturer as we do not have the item in stock the average lead time is 2-16 weeks depending upon the nature of the item ordered and the country of manufacturer origin. Whilst every effort is made to deliver to you within the specified time given, occasionally circumstances beyond our control make this not possible. Therefore deliveries on the stated day for estimated delivery times shall not render us liable for ‘lost time’ or any other consequential costs. All lead times are approximate and may vary. The delivery day or date given is an estimate only. A date given for delivery shall not be the essence of the contract. These delivery terms are in place to protect Now For Bed in the unlikely event of any delivery problems. You must agree to our terms and conditions and at check out stage.

4. Description of Goods
4.1 We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct. Although we aim to keep the Website as up to date as possible, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order.
4.2 All sizes quoted are approximate. The illustrations of colours and covers are representative only. We make every effort to ensure that colours are as close as possible to the actual colours. However, there may be slight variations due to the nature of the medium. We reserve the right to change prices and specification of any item on the Website at our discretion without prior notice or to withdraw any items at any time.
5. Payment
5.1 All prices listed include VAT (Value Added Tax) at the UK standard rate of 15%, except for those products provided for a medical benefit where it is clearly stated that VAT is not being charged.
5.2 Due to circumstances beyond our control prices may have to be increased or decreased including any alterations to VAT. Any special offers will be priced accordingly showing the specific period this item is available on special offer. Payment can be made on the Website by Mastercard, Visa Credit Card, Switch or Delta Debit Card.
5.3 All orders are payable in full before delivery. You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer.
5.4 If the issuer of your card refuses to authorise payment, we will not be liable for any delay or non-delivery and we are not obliged to inform you of he refusal.
5.5 Authority for payment must be given at the time of order. Our liability to you in connection with any order will not exceed the total price charged for the relevant items. We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment. Prices that are reduced for sales and promotions are only valid for the specified period.
6. Final Confirmation Delivery Date
Once your item(s) is ready for despatch either we will contact you or our contracted delivery service will contact you in order to arrange a mutually suitable delivery date.
7. Return Policy - Cancellation of order after delivery
7.1 The Distance Selling Regulations allow the Buyer 7 days in which to make an inspection of the goods and decide whether they are suitable for your needs. This does not mean that you can sleep on your bed or mattress for 7 days and decide whether or not you think it is suitable, rather that you can unpack and inspect the goods as you would have the opportunity to do in a shop. You have a duty in law to take reasonable care of any return goods. We reserve the right to take action against you if any goods are returned to us in a used or soiled condition. 7.2 The Buyer has the right to cancel an order and receive a refund for any item or service, with the exception of bespoke or personalised items. Once you have received your Product(s) from Now For Bed you have 7 working days to decide if you wish to return them. You must inform us in writing, or in another durable medium, if you want to cancel. This includes letter, fax or email. A phone call is not acceptable. Under no circumstances will we accept a cancellation after the 7 day period has expired. If you decide you do not want the good(s) delivered for whatever reason you may return them back to our warehouse, providing you have not used the goods and return them back in good condition to our warehouse. If you would like us to arrange a collection we will make a charge if £1 per mile for the return journey from our warehouse. This will be deducted from your refund. 8. Cancellation of order before delivery
If you cancel the contract before the goods are delivered you will be entitled to a full refund of all monies paid.
To exercise the Buyer’s right of cancellation, you must inform us in writing, or in another durable medium, if you want to cancel. This includes letter, fax or email. A phone call is not acceptable.
Once the Seller has been notified of the cancelling of the Contract, the Supplier will refund or re-credit the Buyer within 30 days for any sum that has been paid or debited from the Buyer’s credit card for the Products.

10. Deliveries
10.1 We use both our own vehicles and other logistics companies to deliver to your home. Your bed/frame or furniture will be taken to the bedroom, staircase access permitting – products will not be assembled unless specific arrangements have been made in which case a charge will apply. Delivery of frames by TNT overnight will only be delivered to your front door.
11. Delivery vehicles
11.1 Customers should assume that the delivery vehicle will be a long, heavy goods vehicle, weighing approximately 16.5 tonnes with a height of 14’3”. Therefore it is the responsibility of the customer to ensure that such a vehicle has legal access to their property and inform us about any weight, height and parking restrictions, as well as any difficult access points and unadopted roads/paths in order to help us deliver your order and ensure that we have made arrangements for the appropriate size of delivery vehicle to be used.
11.2 Failure to disclose this information may result in an aborted delivery and a delivery charge being levied. In order to prevent damage to our/contracted vehicles, unadopted road, paths and tracks will not be taken by delivery vehicles. Alternative routes must be provided by the customer.
12. Delivery Charges
We deliver free in mainland England, Scotland & Wales. We reserve the right to make a charge for delivery to particularly inaccessible locations or where it is not cost effective for us to deliver free. These will be assessed on a case-by-case basis and if you will be notified in advance if we intend to make such a charge. Should you be unhappy with with a charge levied upon you, you have the right to cancel the order and have your money refunded in full. If your delivery address is offshore or in Northern Ireland or the Irish Republic please contact us in advance for delivery costs.
Some selected products also come with free delivery. These products are clearly marked on our website. Multiple orders receiving free delivery will be delivered in one drop. Split date deliveries will be charged accordingly.
